Terms & Conditions – Artwork Purchases

Thank you for your interest in the artwork of Tusif Ahmad.

Each original artwork is individually created by hand and represents many hours, and often several months, of detailed artistic work. Papercutting is an exceptionally delicate and fragile art form. These Terms & Conditions are intended to ensure that collectors understand the nature of the artwork before making a purchase.

By purchasing an artwork directly from Tusif Ahmad or through this website, you acknowledge and agree to the following terms.

1. Original Handmade Artwork

Unless otherwise stated, artworks offered as originals are individually handmade by Tusif Ahmad.

Due to the handmade nature of papercutting, minor variations, natural characteristics of the paper, cutting marks or small irregularities may be present. These are part of the character of an original handmade artwork and should not necessarily be considered defects.

Where an artwork is described as an original or unique work, the purchaser is buying the physical artwork only. Copyright and reproduction rights remain with the artist unless expressly transferred in writing.

2. Please Consider Your Purchase Carefully

Purchasing original art is a personal decision, and we strongly encourage collectors to review all available photographs, dimensions, descriptions and other information before purchasing.

Additional photographs, videos or information about an artwork may be requested before purchase where reasonably available.

Please contact us before purchasing if you have questions regarding the artwork’s appearance, dimensions, materials, condition, framing or display requirements.

3. Change-of-Mind Returns

Because each artwork is an original or individually produced work of art, returns and refunds are generally not accepted simply because you change your mind, decide that the artwork does not suit your space, or no longer wish to keep it after purchase.

Please therefore make your purchasing decision carefully before completing payment.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

4. Fragile Nature of Papercutting

Papercutting is an extremely delicate art medium.

Depending upon the artwork, portions of the design may consist of finely cut paper elements, narrow connections, intricate details and unsupported areas that can be damaged through bending, pressure, moisture, improper handling or incorrect framing.

The purchaser acknowledges the fragile nature of the artwork and agrees to handle, transport, frame and display it with appropriate care.

Once an artwork has been safely delivered and accepted, Tusif Ahmad cannot be responsible for damage caused by subsequent handling, storage, framing, installation, environmental conditions, transportation or other actions outside the artist’s control.

5. Photographs and Colours

Every reasonable effort is made to represent artworks accurately on this website.

However, colours, paper texture, shadows, depth and fine details may appear differently in photographs or on different computer, tablet and mobile displays.

For this reason, slight differences between the appearance of an artwork online and the physical artwork are to be expected.

Where colour, texture or another visual characteristic is particularly important to your purchase decision, please contact us before purchasing and request additional photographs or information.

6. Artwork Dimensions

Artwork dimensions displayed on the website are approximate unless expressly stated otherwise.

Where framing is shown in photographs, please check whether the listed dimensions refer to the artwork itself or the framed dimensions.

If exact measurements are important for installation or framing, please confirm them before completing your purchase.

7. Framed and Unframed Artwork

An artwork will be supplied framed only where it is specifically described as being sold framed.

Where an artwork is supplied unframed, the purchaser is responsible for arranging appropriate professional framing.

Because papercutting is particularly delicate, professional framing is strongly recommended. The artwork should be handled carefully and protected appropriately from moisture, excessive sunlight, physical contact and other environmental conditions that may damage paper.

8. Shipping and Delivery

Original artworks are packed with considerable care because of their fragile nature.

Shipping costs, delivery methods and estimated delivery times may vary according to the artwork’s dimensions, destination, framing and packaging requirements.

International purchasers may also be responsible for customs duties, import taxes, VAT, handling charges or other fees imposed by their country. Unless expressly agreed otherwise, these charges are the responsibility of the purchaser.

9. Damage During Delivery

The purchaser should inspect the package and artwork as soon as reasonably possible after delivery.

If an artwork appears to have been damaged during shipping, please contact us promptly and provide:

• photographs of the external packaging;
• photographs showing any visible damage to the package;
• photographs of the artwork and the damaged area; and
• the order or invoice details.

Please retain all original packaging until the matter has been reviewed.

We will assess shipping damage individually and, where applicable, work with the purchaser and shipping provider to determine an appropriate resolution.

10. Commissions and Custom Artwork

Commissioned artworks are created specifically for an individual collector, organisation or project.

Before work begins, the scope of the commission, approximate dimensions, price, payment schedule and expected completion timeframe will normally be agreed upon.

Deposits or progress payments for commissioned artwork may be non-refundable once design or production work has commenced, except where otherwise required by law or expressly agreed in writing.

Because each artwork is handmade, completion dates are estimates unless a specific delivery date has been expressly guaranteed in writing.

Changes requested after work has commenced may result in additional costs or changes to the expected completion date.

11. Artistic Interpretation

Where an artwork is commissioned based upon a concept, Qur’anic verse, calligraphy, photograph, architectural element or another source of inspiration, the final artwork remains an artistic interpretation by Tusif Ahmad.

The purchaser acknowledges that handmade artwork cannot be expected to reproduce a concept or reference image with mechanical or digital precision.

Reasonable efforts will be made to follow the agreed concept while preserving the artist’s creative interpretation and artistic style.

12. Pricing and Payment

All prices are shown in the currency indicated on the website or quotation.

Prices may be changed at any time before an order or commission has been confirmed.

An artwork is not considered sold or reserved until the required payment or agreed deposit has been received, unless otherwise agreed in writing.

For commissioned artworks, payment terms may be provided separately in the quotation or invoice.

13. Cancellation by the Artist

In unusual circumstances, we reserve the right to cancel an order where an artwork is no longer available, has been sold through another channel, has been incorrectly priced, has suffered damage before dispatch, or where fulfilling the order is not reasonably possible.

If an order is cancelled by us before the artwork is supplied, payments received for that artwork will be refunded as appropriate.

14. Copyright and Intellectual Property

Unless expressly agreed otherwise in writing, purchasing an original artwork does not transfer copyright or intellectual property rights to the purchaser.

All copyright, artistic rights, designs, photographs and reproduction rights remain with Tusif Ahmad.

The purchaser may display the physical artwork for personal enjoyment or as part of their collection, but may not reproduce, commercially publish, manufacture, digitally reproduce, license or otherwise commercially exploit the artwork without prior written permission from the artist.

The artist retains the right to use photographs and other reproductions of sold artworks for portfolios, websites, publications, exhibitions, social media, promotional materials, educational purposes and archival records.

15. Resale of Artwork

Ownership of the physical artwork may be transferred or resold by its lawful owner, subject to applicable law. However, resale of the physical artwork does not transfer copyright or reproduction rights.

Where applicable, resale may also be subject to artists’ resale royalty legislation.

16. Care of Artwork

Paper is naturally sensitive to environmental conditions. Collectors are encouraged to:

• avoid prolonged exposure to direct sunlight;
• protect artwork from moisture and high humidity;
• avoid touching delicate cut areas;
• use appropriate archival-quality framing materials where possible;
• avoid placing pressure directly against delicate paper elements; and
• consult a professional framer experienced with works on paper.

Damage resulting from inappropriate storage, framing, handling, installation or environmental exposure after delivery is not considered a defect in the original artwork.

17. Website Information

We make reasonable efforts to ensure that artwork descriptions, prices, dimensions and availability displayed on the website are accurate.

Occasionally, errors or omissions may occur. We reserve the right to correct such errors and update information where necessary.

18. Privacy

Personal information supplied when making an enquiry or purchase will be handled in accordance with our Privacy Policy and applicable privacy laws.

Payment information may be processed by third-party payment providers and will also be subject to their applicable terms and privacy policies.

19. Limitation of Liability

To the extent permitted by law, Tusif Ahmad will not be responsible for indirect or consequential loss arising from the purchase, ownership, handling, installation or display of an artwork.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under applicable law, including the Australian Consumer Law.

20. Governing Law

These Terms & Conditions are governed by the laws applicable in Western Australia, Australia, subject to any mandatory consumer protections or other laws that may apply.

21. Changes to These Terms

These Terms & Conditions may be updated from time to time.

The version published on this website at the time of purchase will generally apply to that purchase unless otherwise agreed in writing.
